1. Application of These Terms

These Terms apply to all:

  • Retail sales (in-store and online)

  • Custom builds and special orders

  • Bike fitting services

  • Workshop and repair services

  • Bike hire

  • Events and group rides

  • Gift cards and promotional credit

By purchasing goods or services from Chainsmith Pty Ltd (“Chainsmith”, “we”, “us”, “our”), you agree to these Terms.

Nothing in these Terms excludes, restricts or modifies rights under the Australian Consumer Law (ACL).


2. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the ACL.

Where a product has a major failure, you are entitled to a replacement or refund.

Where a product has a minor failure, we may elect to repair or replace.

These rights apply to faults present at the time of supply.


3. Retail Sales (In-Store & Online)

3.1 Pricing & Availability

  • Prices are in AUD.

  • Specifications and availability may change without notice.

  • We reserve the right to correct pricing errors.

3.2 Change of Mind

We do not offer refunds for change of mind on:

  • Bicycles (assembled or custom built)

  • Custom frames

  • Special orders

  • Sale items

  • Helmets and safety equipment

This does not limit your rights under the ACL for faulty goods.

3.3 Risk & Delivery

Risk transfers upon collection or confirmed delivery.

Customers are responsible for inspecting goods upon receipt.


4. Custom Frames & Custom Builds

4.1 Deposits

  • Deposits secure components and production.

  • Once production has commenced, deposits are non-refundable except where required under the ACL.

4.2 Specification & Changes

Custom builds are manufactured to agreed specifications.

Any requested changes after production commences may incur additional cost and delay.

4.3 Geometry & Fit Prescription

Geometry is prescribed based on:

  • Dynamic fit data

  • Rider condition at time of fitting

  • Component selection

  • Intended use

Fit outcomes are based on rider condition at time of assessment.

Geometry prescriptions and fit outcomes are determined using rider data, physical assessment and intended use at the time of consultation.

Cycling position and comfort are influenced by rider conditioning, flexibility, equipment configuration and ongoing use. As these factors naturally evolve, periodic reassessment may be appropriate.

Position refinement is most effective when undertaken holistically and under professional supervision.


5. Bike Fitting Services

Bike fitting is a professional positioning service.

It:

  • Is based on assessment at time of consultation.

  • Is not medical advice.

  • Does not diagnose or treat injury.

  • Cannot predict future changes in rider physiology.

Comfort and performance depend on rider conditioning and ongoing equipment setup.

Follow-up sessions may be recommended where circumstances change.

Service Booking & Cancellation

For appointment-based services (such as bike fits), a deposit is required to secure your booking. Cancellations or rescheduling requests must be made with a minimum of 48 hours’ notice. Deposits are transferable to a re-booked appointment with adequate notice. If a booking is missed without notice, or cancelled with less than 48 hours’ notice, the deposit will be retained. This policy ensures time reserved for you can be offered to other clients in our schedule.


6. Workshop & Repairs

6.1 Estimates

  • Estimates are indicative only.

  • Additional faults discovered during servicing may require approval.

6.2 Pre-Existing Conditions

Chainsmith is not responsible for:

  • Pre-existing damage

  • Undisclosed structural faults

  • Worn components failing after service

6.3 Safety Refusal

We reserve the right to refuse to service equipment deemed unsafe.

6.4 Abandoned Goods

Bicycles not collected within 90 days may incur storage fees and may be disposed of in accordance with NSW law.


7. Post-Delivery Modifications

Where a bicycle or configuration is altered after delivery by:

  • The rider

  • A third-party mechanic

  • A third-party bike fitter

Chainsmith is not responsible for:

  • Performance changes

  • Comfort outcomes

  • Balance or ride characteristics

  • Consequential loss arising from those changes

Once modifications are made outside our supervision, our ability to assess or support the configuration is limited.


8. Bike Hire

8.1 Rider Responsibility

Hire riders:

  • Accept full responsibility for the bicycle during hire.

  • Must wear a helmet.

  • Must comply with road rules.

8.2 Damage & Loss

The hirer is liable for:

  • Damage beyond fair wear and tear

  • Theft or loss during hire

Security deposits may be retained accordingly.

8.3 Risk

Cycling carries inherent risk. Participation is voluntary.

Chainsmith is not liable for injury arising from rider negligence or road conditions, except where required by law.


9. Events & Group Rides

Participation in rides and events is voluntary.

Participants:

  • Accept inherent risks of cycling

  • Ride at their own discretion

  • Are responsible for personal safety and compliance with road laws

Chainsmith is not liable for injury, loss or damage arising from participation, except where required by law.


10. Performance & Comfort

Cycling comfort and performance depend on:

  • Rider conditioning

  • Training load

  • Equipment setup

  • Maintenance

Chainsmith provides services with due care and skill.

We do not warrant:

  • Pain-free riding

  • Injury prevention

  • Performance outcomes independent of rider effort


11. Warranty

Manufacturer warranties apply as provided by respective brands.

Warranty does not cover:

  • Wear and tear

  • Third-party modification

  • Improper installation

  • Accidental damage


12. Limitation of Liability

To the extent permitted by law:

  • Liability is limited to remedies under the ACL.

  • Chainsmith is not liable for indirect or consequential loss except where required by law.

Nothing in these Terms excludes liability that cannot lawfully be excluded.


13. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
